| Аннотация: | У статті на основі застосування методів аналізу та порівняння розглянуто процес розвитку та становлення сучасного законодавства щодо ліквідації боржника-банкрута. Показано, що сучасний стан законодавства прямо
залежить від історичного розвитку зазначеної галузі та
становлення інституту банкрутства, зокрема на території сучасної України та інших розвинених у той час
країн. Зроблено висновок, що без ретельного розгляду історичного аспекту виникнення та розвитку інституту неспроможності неможливо говорити про сучасні реалії цієї
галузі вітчизняного та зарубіжного законодавства. |
| Описание: | In the article, based on the application of methods of analysis and comparison, the development and formation of modern legislation on the liquidation of a bankrupt debtor is considered. It is shown that the current state of legislation directly depends on the historical development of the industry and the establishment
of the institution of bankruptcy, in particular, on the territory of modern Ukraine and other, developed at
that time states. It is concluded that without careful consideration of the historical aspect of the emergence
and development of the insolvency institution, it is impossible to speak about the current realities of this
branch of domestic and foreign legislation. A fairly large-scale comparative analysis of the bankruptcy laws
of different states and different periods of their existence was conducted: Ancient Rome, Kievan Rus, the
Russian Empire, the USSR. Legislative acts of independent Ukraine are analyzed, the invalid regulating
relations in the field of insolvency in the past years. The work establishes unconditional interconnectedness
of the currently existing domestic legislation in the field of bankruptcy, and its development and the process
of formation from ancient times. Despite the fact that in each country this process took place in different ways,
there are some common traits to all of them: there is always and everywhere a debtor who is to blame for money
and can not return them, and there is a lender who wants to return his money back, in any way (at the expense of
property, at the expense of the work of the debtor himself, etc.). Such an approach was irrelevant only during the
time of the command economy, when Ukraine was the part of the USSR and the state independently regulated all
financial issues. However, we should pay attention to the fact that over time everything has returned to its place
and history has proven that the institution of bankruptcy ― it is really an important tool in the economy of any
country and it is simply impossible to do without it for a long time. |
